US Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.
The situation stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the court pointed out that the government does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
Background of the Legal Challenge
The court proceedings center on conflicting assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in the state of Tennessee.
Terms of Release
The judge, who was overseeing his petition to removal in a Maryland district court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
This decision marks a significant turn in a complex immigration battle involving claims of mistaken imprisonment and contested gang associations.
